Scott Stanley and outside counsel successfully defended the appeal from a defendant who was found 100% liable for the negligent operation of a utility vehicle resulting in a spinal cord injury. The trial judgments of $5,962,670.36 were upheld. The award for double costs against the defendant was upheld even though the Plaintiff had revoked her formal offer and replaced it with increasingly higher offers.

Irina Kordic and Jeff Nieuwenburg acted for Ms. Vujevic who was injured when a vehicle parked on the side of a road suddenly pulled out and struck her vehicle. The defendant claimed that her vehicle was not pulled over but in the middle of the roadway, arguing that Ms. Vujevic had crossed over the centre line to pass illegally. The judge did not accept these claims, and found the defendant wholly liable for the accident. Ms. Vujevic continued to work as a hairstylist following the collision, but her earnings and career advancement were affected by her injuries. After a trial in BC Supreme Court, Ms. Vujevic was awarded approximately $800,000 in damages.

Scott Stanley and outside counsel successfully obtained an order certifying a class action against the Province of B.C. on behalf of ICBC Ratepayers who allege that they were charged an illegal tax which caused their insurance rates to be increased unnecessarily. The amount in question is believed to be in excess of $1 billion.

Brandon Souza acted for the plaintiff who suffered chronic pain injuries to her neck and back. After the accident, the plaintiff began her nursing career which was limited due to her accident-related injuries. ICBC claimed that the plaintiff’s injuries had resolved within a year of the accident and her current limitations were not caused by the accident. The court disagreed with ICBC and awarded the plaintiff $509,242.

Brandon Souza acted for the plaintiff who suffered a fractured ankle and aggravated previous chronic pain injuries. The plaintiff had a checkered past, extremely limited work history, and major pre-existing injuries. The plaintiff was awarded $240,665.40.
