Court upholds $1.14M fire-pit explosion decision against City of Burnaby and tenants

B.C.’s top court recently upheld a trial court decision awarding $1.14 million in damages to one of Murphy Battista’s clients. Scott Stanley and Paul Bosco represented Ms. Abdi who was seriously injured in a backyard fire-pit explosion caused when the tenants of a property owned by the City of Burnaby poured a bucket of used motor oil onto the fire. The Court of Appeal rejected the tenant’s and landlord’s arguments that the plaintiff’s injuries were not foreseeable and that the injured victim was the cause of her own injuries.
This case is important for injury victims in B.C. because it explores new areas of the law on landlord and tenant liability, and established liability following awareness of ongoing hazards.
