Murphy Battista LLP Founder Joe Murphy, QC and Murphy Battista Partner Scott Stanley recently took to the airwaves for the second episode of the new AM 650 radio program “The Law Show”. The program airs once a month, on select Sundays at 11:00 am, and is hosted by veteran radio personality Stirling Faux. Each episode features experienced personal injury lawyers from the Murphy Battista team discussing issues that commonly arise in insurance disputes.

In this episode of the program, Scott and Joe once again spent some of their time discussing Murphy Battista’s business practices. In particular, the two emphasized how Murphy Battista represents clients from all around the world in addition to Vancouver residents. Further, Joe and Scott discussed the industry-wide practice of contingency fees and how Murphy Battista’s lawyers only receive payment from a client if they succeed in achieving a reward or settlement.

Scott and Joe also took advantage of their time on the radio show to discuss ICBC claims involving children. The two mentioned that the laws regarding minors involved in accidents are unique and that – although children should still retain counsel immediately after being injured – they can pursue a claim at anytime prior to their 21^st birthday. In the case of adults injured in a car accident, there is usually a two-year time limit in which a claim can be filed. Joe Murphy explained that his longest case went on for 18 years and involved a young girl who was injured at 2 years of age that eventually was able to reach settlement when she was 20. Joe commented that, in this case, it was important that the entire developmental process was complete before they discussed the terms of settlement and that often injuries sustained in childhood don’t completely manifest until much later on.

In addition to discussing claims involving children, Joe and Scott also took time to highlight the steps that should be taken immediately following an accident, the differences between an ICBC Claim and a lawsuit, how to deal with paperwork that ICBC adjusters ask you to sign, what information you are obligated to provide to ICBC, uninsured motorist protection, and the ramifications of being involved in an accident while on a cellphone.
